En el presente trabajo podemos contemplar un riguroso análisis sistemático de las diferentes normas nacionales e internacionales que forman el bloque de constitucionalidad. Este análisis sirve de base para entender las restricciones que debe respetar el legislador, pero se muestran casos donde el legislador actúa en contra de las mismas, generando la desprotección de ciertos grupos. Sin dudas, este es un trabajo que colabora con el debate sobre la aplicación del derecho del trabajo en general.

La cultura del presentismo se encuentra muy arraigada en nuestra práctica laboral y se ve mal (o muy mal) que un trabajador cese sus labores a su hora, calificándolo de poco comprometido o de “burócrata”, lo cual es paradójico porque son miles los servidores públicos que no cuentan con una jornada máxima de trabajo. Lo que no se asimila es que el tiempo de trabajo es lo contrario del tiempo libre, con lo cual todas las horas que uno está en el trabajo son horas en las que no cuenta con libertad para hacer otras cosas (estudiar, ir al cine, pasar tiempo con la familia, etc.). Y eso puede causar enfermedades o hasta la muerte al trabajador. El presente trabajo busca reflexionar sobre este tema tan importante en la vida de las personas.

The Internal Labor Regulations is a rule law that could be created by the employer. In that sense, its position in the system of sources is residual because it can not contravene the government rules nor the collective agreement content. However, case law has considered it many times to assess the validity of a dismissal or the existence of an employment relationship. This article seeks to review these issues and to assess the validity of the rule that regulates it (Supreme Decree 39-91-TR).

El derecho constitucional a la huelga es desarrollado en el Perú mediante una normativa muy estricta que condiciona la procedencia de la medida a una opinión de la autoridad administrativa de trabajo que puede ser emitida en doble instancia. Sin embargo, existen normas que permitirían entender la existencia de la huelga a pesar de no contar con la aprobación de dicha autoridad dado que impiden al empleador poder ejercer con libertad su facultad disciplinaria ante una paralización improcedente o ilegal. A propósito de recientes decisiones de la inspección de trabajo, el presente artículo analiza esta situación y busca presentar algunas soluciones coherentes con el contenido esencial del derecho constitucional.

The constitutional right to strike in Peru is developed by a very strict policy that determines the origin of the measure to a view of the administrative labor authority that may be issued in two instances. However, there are rules that allow understand the existence of the strike despite not having the decision of that authority as they prevent the employer to freely exercise its disciplinary powers to an improper or illegal paralysis. With regard to recent decisions of the labor inspection, this article analyzes this situation and seeks to present some solutions consistent with the essential content of this constitutional right.

The culture of presenteeism is deeply rooted in our labor practice and looks bad (or very bad) that an employee cease its work on time, calling uncommitted or “bureaucrat”, which is paradoxical because there are thousands of public servers that do not have a maximum working time. What is not assimilated is that working time is the opposite of free time, which all the hours you’re at work are hours when you do not have freedom to do other things (studying, going to the movies, spending time with family, etc.). And that can cause illness or even kill the employee. This paper seeks to reflect on this important subject in the lives of individuals.
