El presente trabajo realizará, en una primera instancia, un análisis sobre el desarrollo y la importancia del derecho constitucional para la protección de los derechos de la persona a lo largo de la historia del mundo y del Perú. También se analizará cómo el derecho civil y el derecho constitucional han funcionado en la historia de nuestro país. Para ello, se tendrá que recurrir a los tres códigos civiles que hemos tenido. Finalmente, con la presente investigación se desarrollará cómo las constituciones a lo largo del mundo no amparan ni protegen los derechos humanos de igual manera, lo cual genera una interrogante mayor que merece ser respondida: ¿verdaderamente las constituciones protegen a las personas?, ¿o hay situaciones en las que sus derechos son violados? This article examines the concept of voluntary remediation as an exemption from liability in the administrative sanctioning procedure, highlighting its connection with the preventive and corrective approach to oversight provided for in the Consolidated Text of the Law 27444, General Administrative Procedure Law, approved by Supreme Decree 004-2019-JUS. It questions the restrictive interpretation adopted by various administrative entities which, through unilateral requirements, distort the corrective purpose of correction. Through a normative, jurisprudential, and economic analysis, the authors argue that this legal concept must be applied in a manner consistent with the principles of regulatory compliance and administrative efficiency, promoting early correction rather than sanctioning.
