The use of standardized contracts in the implementation of public infrastructure projects has marked a milestone in infrastructure investment policies in Peru. Since 2019, New Engineering Contracts (NEC) have been the ones that have had significant use in construction projects in which one of the contracting parties is the Peruvian State. Therefore, the need arises to study financing risk management and its specific regulation in this type of contract. Given the importance of correct financing risk management in a NEC contract, this article will analyze the related duties and obligations, as well as the origin and consequences of the well-known.

El presente trabajo de investigación busca analizar y evidenciar la incompleta e incorrecta regulación que el ordenamiento peruano le ha brindado a la actividad empresarial del Estado. Para dicho fin, se parte de un análisis antropológico acerca del nacimiento del concepto católico de ‘‘subsidiariedad’’, buscando así informar al lector que la subsidiariedad es un concepto social y humanista antes económico. Posteriormente, se analiza el tratamiento legal que brinda INDECOPI a dicho principio a través de conocidas resoluciones. Finalmente, se propone un debate en torno a la incorrecta regulación que se ha establecido para controlar la actividad del Estado a través de los actos de violación de normas.
