El tema de la valoración racional de la prueba es de gran importancia, no solo porque la realidad y el derecho encuentran un ámbito de imbricación en el proceso judicial sino porque la verdad que se pretende encontrar con la valoración de las pruebas va a determinar el sentido de la decisión judicial. Vista esta trascendencia de los hechos y las pruebas, y partiendo de un marco teórico constitucional relativo al debido proceso, tutela jurisdiccional, debida motivación y valoración racional de la prueba es que se analiza estos derechos fundamentales en el escenario del proceso y, especialmente, a través de las sentencias del Tribunal Constitucional emitidas durante aproximadamente las dos últimas décadas.
