This article analyzes the evolution in understanding the nature of the special trial established in Law 30364 - Law to Prevent, Punish, and Eradicate ViolenceAgainst Women and Other Members of the Family Group, pointing out the doubts generated by the procedural loopholes of such law when it was promulgated and its subsequent interpretation when its regulations came into force, establishing its main characteristics so that it is better understood when applied by the justice officials.

The purpose of this article is to analyze the rights that reach the child or adolescent when they are immersed in a process of challenge of paternity, in this way, seeks to define the regulatory context established in the irrevocability and expiration of the denial of recognition of filiation, established in articles 395º and 400º of the civil code. Likewise, the right to the child’s identity will be analyzed, both in its static aspect and in the dynamics and the right to be integrated to its biological family, with the purpose of understanding with greater amplitude the invoked rights and being able to make a correct weighing before an evident collision of principles; searching in response what most benefits the child or adolescent.

In this academic work we will analyze the procedural legal figure of preventive confinement, in order to determine if said measure is being applied within the framework and limits of the procedural guarantees established by the Convention on the Rights of the Child, the Constitution and laws of the specialty. We will reflect on the procedural guarantees that the Judiciary must take into account when deciding on a request for preventive admission. Similarly, we will examine the rights of adolescents deprived of their liberty and which must be guaranteed by the state while they are in their preventive custody, such as the right to health and physical and psychological integrity. Maxima if we are in a situation of health emergency and global pandemic.
