La presente investigación tuvo como objetivo determinar de qué manera la propuesta y acción jurídico-política de Miguelina Aurora Acosta Cárdenas influyó en el surgimiento del feminismo jurídico en el Perú. El enfoque fue cualitativo, tipo básica, de teoría fundamentada y diseño no experimental. Gender perspective is an influential approach in the current context; however, regional studies have not delved into its origin and impact in the legal field. For this reason, this research aims to highlight how a clear understanding and delimitation of the phenomenon in question is already visualized within the reflections of Miguelina Aurora Acosta Cárdenas, trial attorney of the twentieth century. Therefore, based on the analysis of her articles «Reacción femenina en 1918» and «La absolución de Victoria Alfaro y el Dr. Federico Pflucker in 1919», I will try to show that the work of this author considers significant contributions such as the consideration of gender perspective or contextual, structural-historical analysis of the female situation when exercising the right to a defense.

The study presents the results of a bibliographic review on constitutionalism that was established after the war of independence and that was assumed by the Constituent Congress of 1822. From the perspective of the historiography of law with an interdisciplinary approach, it is proposed a valuation of the role and contribution of women, peasants and Afro-descendants to the political independence of our country. From this, it can be affirmed that the founding of the republic was the product of a complex socio-political process, and that the official and patriarchal history has made invisible the other protagonists, the population sectors historically excluded from the political, legal, economic and constitutional of said Constituent Congress.
