ABSTRACT The present research was carried out with the purpose of determining the extent to which the PODA Collaborative Project improves the democratic attitude in the fourth grade students of the "Santa Rosa" Educational Institution of Trujillo, 2017. The research included a study population of 434 students and the sample consisted of 84 students; 42 in the experimental group and 42 in the control group; which have similar age and characteristics. The collaborative project PODA, is constituted by four dimensions, thought, opinion, decision and action; and was implemented as a learning strategy in the classroom for the area of Person, Family and Human Relations, Civic and Civic Education and in the Social Sciences in general. La presente investigación tuvo como motivación principal el plantear una alternativa de solución ante una problemática lamentable que se incrementa cada año, como es el caso de fallecimiento de personas a causa de negligencias médicas. Ante ello se planteó como objetivo principal el determinar la necesidad de regular un tipo penal específico para negligencia médica en el código penal peruano. La metodología que se eligió fue seleccionar una muestra de estudio de manera aleatoria, que estuvo conformada por 20 Fiscales del Ministerio Público de La libertad: 06 fiscales provinciales penales y 14 fiscales adjuntos; 10 Jueces penales de la Corte Superior de Justicia de La Libertad, así mismo se entrevistó a 2 abogados funcionarios de la Defensoría del Pueblo, entidad que vela por la protección de derechos fundamentales como son la vida y la salud.
