In recent years, arbitration has been an alternative route to judicial proceedings, especially in commercial disputes. This, as a result of its lottery, for its flexibility, speed, confidentiality, among other aspects. Nonetheless, part of the doctrine considers that this route is not suitable for private disputes relating to matters of antitrust law. In this article, the authors assess the scope of arbitrability, in private matters, on antitrust law in Peru. Thus, they examine whether the courts may interpret compliance with antitrust laws and subsequently issue a ruling on civil liability resulting from this analysis. Este informe analiza la denuncia de eliminación de barreras burocráticas presentada por Altozano Desarrollo y Construcción S.A.C. y Altozano Torres de Arequipa S.A.C. en contra de la Empresa Prestadora de Servicios de Agua Potable y Alcantarillado de Arequipa, en el marco de la solicitud de acceso a la provisión de los servicios de agua potable y alcantarillado sanitario para la ejecución del proyecto inmobiliario “La Arboleda”, ubicado en el distrito de Cerro Colorado, provincia y región de Arequipa. New technologies have led to a 180 degree turn in the way society shares, consumes and accesses information. However, just as the media has contributed to personal and social development, the panorama in recent years has changed as a result of the growing wave of false information on the internet.In this article, the authors determine the risks involved in spreading fake news about the COVID-19 pandemic and assess whether current national legislation, based on what international parameters have established, manages to mitigate this issue that has forced even the most developed legislations in the world to modify the scope and effects of their regulations.
