El hecho o factor religioso puede tener incidencia en el ordenamiento jurídico de un país, y; en ese sentido atravesar todas las ramas del derecho, entre ellas la del derecho penal. El Código Penal Peruano no es ajeno a esta realidad jurídica y aunque no regula exclusivamente bajo un título, capitulo o subcapítulo, al hecho o factor religioso o a la libertad religiosa, subyace una referencia indirecta cuando se regulan los diferentes tipos delictivos en el Segundo Libro del referido Código Penal como será desarrollado a lo largo del presente artículo.

The recent modifications that Legislative Decree No. 1377 has brought and its effect on institutions as well as on the modalities in which compliance with the food institution is sought leads us to analyze again the viability of the regulation and its respective regulations as also the way in which they have been applied in the national  reality. Only with an adequate rethinking will it create the desired effect by its creators and its compliance by society and the role played by the State.
