El presente trabajo desarrolla la institución laboral de la subcontratación a través de sus variantes intermediación laboral y tercerización, analizando sus principales aspectos normativos. A su vez, el autor expone las principales falencias presentes que generan una degradación de las condiciones de trabajo y plantea la necesidad de establecer mecanismos de tutela más allá de la responsabilidad solidaria dirigidas a fortalecer las relaciones colectivas, modernizar la justicia laboral y fortalecer los sistemas inspectivos.

In the article, the author analyzes the denaturing in labour outsourcing using relevant case law. Also, the author addresses the advantages of outsourcing and its negative impact in workers’ conditions. The author proposes the realization of a caseby-case analysis, in order to analyze whether the denaturing of the outsourcing occurs in each specific case and, thus, avoid excesses.

Cyberbullying at work constitutes, undoubtedly, a form of violence exacerbated by the use of Information and Communication Technologies, of a multi-offensive nature as it involves an impairment of both unspecific and specifically labor fundamental rights. In this paper we reflect on its manifestations and the response formulated by the Peruvian labor law. For its preparation we have resorted to bibliographic research, through access to texts in English and Spanish that address cyberbullying. Likewise, the main conclusions point to rescuing how fundamental it is to adopt preventive measures, such as training staff on workplace about cyberbullying practices or how to avoid them, but also to commit the company's senior management. The recent trend in labor jurisprudence passes liability to the employer in the event of an accident at work or occupational disease. This violates the theory of contractual civil liability, applicable to the employment relationship, which requires fraud, gross negligence or at least slight negligence for the generation of the employer’s duty to compensate the employee. In this paper we legally analyze how employer responsibility has evolved and critically approach the current criteria, formulating some proposals for future change.

After a conceptual overview of the scope of the right to job stability, its relationship with other rights (right to work, right to access to employment, right to maintain employment) and its constitutional, international and legal regulation and the position of jurisprudence, the author goes on to discuss the complex picture presented to the employer before a decision to dismiss both from a legal perspective (compensation, replacement) and case law (damages, replacement) adding a paragraph called “others” the recount administrative consequences arising from said measure both labor (SUNAFIL) and tax (SUNAT) viewpoint.

Luego de un breve repaso conceptual de los alcances del derecho a la estabilidad laboral, su relación con otros derechos (derecho al trabajo, derecho de acceso al empleo, derecho a conservar el empleo) y su regulación constitucional, internacional y legal, así como la posición de la jurisprudencia, el autor pasa a comentar el complejo panorama que se presenta al empleador ante una decisión de despido tanto desde la óptica legal (indemnización, reposición) como jurisprudencial (indemnización por daños, reposición) añadiéndose un acápite denominado “otros” para las relatar las consecuencias administrativas que surgen de la indicada medida tanto desde la óptica laboral (SUNAFIL) como tributaria (SUNAT).

The purchase of companies, mergers, spin-offs, reorganizations in general, constitute extremely complex operations that impact, of course, the underlying corporate relationships to the companies that are subject to them. There is also a natural effect on the taxation of corporations and people involved. However, a fundamental edge is the effect of said operations on the working relationships of personnel employed by the participating companies. In this article we analyze the aforementioned effect and the existence of responses by our legal system.
