According to Peruvian legislation, through an escrow agreement a trustor transfers under a fiduciary domain in favor of an escrow agent various goods, rights and obligations, which must achieve certain purpose. These will constitute an autonomous patrimony that does not respond any obligation of the trustor and the agent escrow. Despite the clarity of this statement, the authors reveal that indeed there might be different interpretations about this agreement that have practical consequences with the treatment of real properties subject to fiduciary dominion.

Analiza y determina la naturaleza jurídica de la Junta de Propietarios. Para analizar cabalmente las implicancias de la existencia de una Junta de Propietarios, se hace uso de la investigación interpretativa y positiva. De esta forma, podemos concluir que la Junta de Propietarios no posee una adecuada regulación en nuestra legislación, lo cual se demuestra con la falta de una normativa adecuada o expresa que permitan solucionar las controversias respecto a temas como la limitación de derechos fundamentales por falta de pago del copropietario, el desconocimiento por parte de los operadores jurídicos de los derechos reales constituidos en el régimen de la propiedad horizontal o las sesiones virtuales durante pandemia, entre otros.
