The purpose of this thesis is to determine whether or not what is regulated in Law No. 26662 - “Law of Notarial Competence in non-contentious matters” violates the right to receive an inheritance, that is, to determine whether article 39 satisfies the essential requirements for the exercise of the right to inheritance, in addition, examine the consequences of notarial intervention when there is more than one heir and one is harmed by the request, which is made unilaterally, and propose new criteria that improve the procedure. After a detailed and descriptive analysis, it has been revealed that the majority of those interviewed consider that the procedure for the notarial declaration of heirs does violate the right to inheritance.
