The instigation of terrorism and other similar crimes that punish incitement or enhancement of terrorism are experiencing an exponential growth in its regulation all over the world. In Spain and Peru this trend is not new: since the 1990’s a large number of legal modifications have criminalized such practices. A compared and evolutive study of these crimes and the jurisprudence trends are offered in this paper.

La apología del terrorismo y otros delitos de similar calado que castigan la incitación o el enaltecimiento del terrorismo están experimentando un crecimiento exponencial en su tipificación alrededor de todo el mundo. En España y Perú esta tendencia no es nueva: desde la década de los años 1990 se han ido sucediendo diversas reformas que tipificaban de distinta manera los comportamientos mencionados. En el presente trabajo se analiza la evolución comparada de estos delitos y las tendencias marcadas por la jurisprudencia.
