En el presente artículo, el autor nos comparte algunas reflexiones en torno a la posibilidad de aplicar el artículo 1135 del Código Civil a la solución de un caso de mejor de derecho de propiedad. Para tal efecto, realiza algunos comentarios a una sentencia emitida por nuestra Corte Suprema, la cual da solución a una controversia de esa misma naturaleza. De ese modo, llega a concluir que dicha norma no solo se limita a solucionar un conflicto meramente obligacional, sino que también funciona como un dispositivo de asignación definitiva de titularidades como la propiedad.

The Fourth Casatory Plenary has encountered significant challenges due to the evolving circumstances. The acquisitive prescription or usucapion turns out to be one of the most important figures in our regulations regarding property. As it turns out, it is not only a way to acquire the domain, but the only reliable way to prove ownership status.Along these lines, the present work makes a study of the concept of usucapion and its function as ‘proof of dominance’. This gives way to an analysis of the argument surrounding the ‘owner’s statute of limitations’, by examining national jurisprudence on the matter.Finally, to expose the practicality in the acceptance and application of the concept at a casuistic level.The author concludes that, through the acceptance of the theory of the ‘owner’s prescription’ and a correct application of it, it is possible to solve a series of controversies linked to the determination of the t...

This gives way to an analysis of the argument surrounding the ‘owner’s statute of limitations’, by examining national jurisprudence on the matter.Finally, to expose the practicality in the acceptance and application of the concept at a casuistic level. The author concludes that, through the acceptance of the theory of the ‘owner’s prescription’ and a correct application of it, it is possible to solve a series of controversies linked to the determination of the true owner.

Busca darle un enfoque distinto a los problemas que en la actualidad surgen como consecuencia de una declaración judicial (o arbitral) de nulidad y cómo es que ésta repercute sobre los derechos y situaciones jurídicas en general adquiridas por terceros contratantes. The authors not only analyze the conflict resolution methods, but also the rights conceded to each individual in the commercial relationship, and the sources from which those rights are born. The authors underline the importance of having a solid and cohesive legal framework before starting any investments in a foreign country, and to that end the Investment Treaties constitute an important structure to reassure the investors that their capital will be protected under every circumstance.
