En el presente artículo el autor analiza los principios rectores en los que se sostiene el libro de acto jurídico de nuestro código civil, a fin de establecer claramente el marco sobre el cual puede desarrollarse coherentemente una teoría del error. Para ello, el autor expone las posiciones más relevante en torno al valor de la voluntad y la declaración en el negocio jurídico, resaltándose la relevancia que tiene la teoría de la confianza en el código civil. A continuación, se presenta un texto de lectura básica para comprender el principio y los conceptos básicos por los cuales se rige nuestro ordenamiento en el libro de acto jurídico.

This article examines the relationship between private autonomy and the law in the field of civil law. The author believes that, although modern developments or current phenomena, such as globalisation and the weakening of the public sphere, are intended to strengthen civil law, they are in fact undermining its foundations. To that extent, these changes are distorting the conception of private autonomy and the legal system, which poses a problem for civil law and law in general. Furthermore, the author argues that private autonomy, although a social phenomenon that precedes the state system, cannot be equated with the functions and powers of the state. In that context, this paper provides a thoughtful critique of the current challenges facing civil law in relation to private autonomy and the principle of legality.

This article analyses the legal figure of the performance of obligations by a third party and the implications that this entails in the relationship between the obligee and the obligor. In this context, it is essential to emphasise that the third party's performance may be limited by the debtor's opposition, who has the right to be personally discharged from his obligation. This right to discharge may also be subject to the consent of the obligee, who has the right to justifiably refuse the intervention of the third party in the performance of the obligation.
