El objetivo de la tesis es analizar la aplicación del artículo 861 del Código de Comercio a los contratos de fletamento y los contratos de transporte de mercaderías por mar. Para ello, se revisa las últimas sentencias de la Corte Suprema en relación a las averías marítimas, pues la no aplicación del artículo en análisis genera una inseguridad que es percibida por las líneas marítimas alrededor del mundo y perjudicando así el propio negocio del transporte de mercaderías por mar. Finalmente, se considera imperativa la revisión de la institución jurídica de la avería marítima, con el objetivo de dar un estudio consciente sobre la vigencia del artículo en mención y dar una opinión sobre esta controversia en la que los operadores y participantes del transporte marítimo de mercancías se han enfrascado.
