The Therapeutic Abortion Protocol (PAT), in force since 2014, regulates the procedure for the execution of therapeutic abortions nationwide. Establishes an open list of clinical entities for access, under the Informed Consent of the pregnant woman and not including the rights of her child. This rule generates in the medical professional the obligation to perform abortions, which may contradict the precepts of his conscience about the indiscriminate respect of all human life, restricting his constitutional right to freedom of conscience. Debido al avance de la ciencia y la tecnología, la medicina puede solucionar los problemas de salud que se presenten en el embarazo, tanto para la madre gestante como para la persona que se desarrolla en su vientre. Pese a ello, aún hay casos en que los profesionales pronostican un riesgo grave para la vida o la salud de la madre gestante o la de su hijo, llegando a ocurrir un aborto terapéutico. Este tipo de aborto está despenalizado en nuestro país desde 1924 (Código Penal (CP), art. 119). El Protocolo de Aborto Terapéutico (PAT), vigente desde el 2014, regula el procedimiento para su ejecución a nivel nacional. Therapeutic abortion is a medical practice that has been decriminalized in our country and is currently regulated under a standardized procedure at the national level in the so-called Protocol of Therapeutic Abortion (PAT), requiring the informed consent (IC) of the pregnant woman but without considering the rights of the child. The present paper contains both a bioethical analysis, from a principialistic and personalistic perspective, and a legislative analysis of the IC of the pregnant woman regulated by the PAT as a requirement for the realization of an abortion for therapeutic reasons. It seeks to discern its degree of suitability, both from a bioethical and a legal standpoint.
