El presente artículo detalla todos los aspectos generales relativos a las hipotecas acuícolas, en tanto clase especial de hipotecas. Así, el autor comienza por detallar algunas de las hipotecas especiales para después explicar la acuícola, así como sus alcances, qué se garantiza con ella y demás aspectos regulatorios y procedimentales que deberán tenerse en cuenta para su correcta inscripción en los Registros Públicos.

El autor analiza y critica la Casación 34-2010-La Libertad, que otorga potestad a los registradores de calificar la validez de los actos administrativos presentados para inscripción. Asimismo, el autor ahonda en los conceptos de validez de los actos administrativos y las potestades del registrador encontrando asistemática dicha sentencia con la normativa pertinente.

It seeks, through it,to grant legal protection to the owner of the registration, by the registration publicity itbrings.In this article, the author analyzes thisimportant legal figure, by focusing on the article 2013 of the Peruvian Civil Code, whichhe considers must be renovated and updated, according to the circumstances and recent regulatory changes.

This article analyzes two central points, which are the expropriation from a criticism on what the new Expropiation Law indicates; and from that law, the author will refer about the role of registration qualification and how it has developed in practice. Finally, the author concludes three important issues that they have been derived from the analysis of the law, and presents the conclusions through a critique to the issue of property in our country.

The article develops the variety of restrictions to the right to property in Peru, many of them overlooked, but very necessary to know. In this task, the author also takes a position on the controversial restriction on the transfer and encumbrance of property by agreement between private parties.Some limitations have been pronounced by the highest administrative registry instance: the Registry Court; the author questions its legislative power through an analysis of the changes brought about by the plenary sessions LXII, XCIV and XCIX, in addition to the pronouncements of the Constitutional Court and the provisions of the Civil Code of 40 years of validity.

The author of this text makes a description of the functioning of an institutionthat is sometimes set aside of the legal literature: the Justice of the Peace. Justiceof the Peace is a judicial authority that has a great importance in Peru, given thenumber of people that are not able to come before regular courts, in order to solvetheir controversies.
