This text seeks to develop the different possibilities that the law offers to influence the right to the environment and combat climate change. In this way, it presents the climate commitments and how these are obligations that States must comply with. Likewise, it studies the environmental legislation in force in Peru, both the positive legislation and that which does not necessarily protect the right to the environment. And, finally, we study the possibility of using strategic litigation at both the national and international level so that citizens themselves can seek to undo situations generated by state or private agents that seek to affect the right to the environment.

Existen básicamente dos sistemas de titularidad sobre los recursos minerales: el sistema dominalista, que separa la propiedad del suelo de la propiedad del subsuelo; y el sistema de accesión o fundiario, que unifica la propiedad de suelo y subsuelo. La idea para esta tesis se nos ocurrió con una oreja en el aula de derecho y la otra en la calle. En esta última escuchábamos dos clases de ideas, casi paradigmas: una hacía referencia a que el Perú avanzaba económicamente gracias en gran parte a la minería; la otra señalaba que estos avances eran muchas veces frenados por “activistas”, “izquierdistas” y “antimineros” que supuestamente no querían el progreso del país, dentro de los cuales muchas veces se encontraban los pobladores de las comunidades aledañas a estos proyectos.
