El objeto de este trabajo es contribuir a esclarecer una discusión entre dos referentes de la Filosofía del Derecho actual: Luigi Ferrajoli y Manuel Atienza. A pesar de las extendidas coincidencias entre ambos, discrepan sobre la mejor concepción que pueda dar cuenta de los Estados Constitucionales de Derecho: si el positivismo jurídico o un paradigma post-postivista. El origen de la discusión es identificado con algo previo: su rechazo o aceptación, respectivamente, del objetivismo moral; es decir, que sus discrepancias teóricas son un reflejo de sus distintas concepciones metaéticas. This article evaluates the type of teaching provided in Peruvian law schools. The author points out that the current training process follows the positivist tradition. This model conceives of the law as a system of rules, which implies fidelity to the law and its mechanical application to the concrete case. However, it is clear that this approach does not respond to a social reality that requires a change in the law. The consequence of following this traditional approach is that students often end up with an understanding of the law that does not correspond to legal reality and practice. For this reason, it is proposed to adopt a view of law as a social practice rather than a set of rules and principles. The purpose of this article is to contribute to the discussion of the legal arguments contained in the sentence issued by the Constitutional Court. The topic discussed was the constitutional protection filed by the Pontificia Universidad Católica del Peru against the judgment of the Eighth Civil Chamber of the Superior Court of Justice of Lima, which was declared unfounded. The debate focuses on how the decision of the majority of the magistrates has been. For this reason, the author will carry out an analysis from the argumentative approach in which he demonstrates why he finds it unjustified and arbitrary. This paper focus in the skills and knowledge in which a law student must be educated. The author indicates that justice theories is one aspect in which a student must be educated. Likewise, he refers that the education based on legal skill development is fine, but we must understand that it be though not in what a lawyer does, but in the knowledge of the Law along with the capacity to argue legally from it. In addition, it is necessary that the students know the legal reasons universe and know how to use them to bring a solution for a case from the Law. It be reinforce the idea that the Law education must not be finish on its description, but in teaching about the use of its categories. La indeterminación de lo que el Derecho es y, en consecuencia, de lo que implica el ejercicio de la profesión hace de esta una pregunta particularmente difícil. Si atendiéramos a cuanta explicación se ha postulado de lo que el Derecho es, tendríamos un gran problema para determinar los conocimientos y las habilidades en que deberíamos formar a nuestros estudiantes. Así, entendido como un conjunto de normas justas, nuestros estudiantes deberían ser formados en teorías de la justicia; entendido como un conjunto de normas eficaces, la formación no podría prescindir de teorías sociológicas; o, entendido como un conjunto de normas válidas, el estudiante requeriría de recursos lógicos para identificar el Derecho.
