El presente artículo tiene como objetivo introducir algunas ideas sobre la naturaleza del Tribunal Constitucional en general, y del rol del juez constitucional en particular. En ese sentido, se resalta la labor del Tribunal Constitucional peruano como garante de los derechos fundamentales y la separación de poderes dentro de todo Estado constitucional que se precie de serlo.

Se abordan en este artículo los mecanismos y técnicas adoptados en el Perú para la selección de magistrados en las diversas instancias de la administración de justicia, resaltando el papel que desempeña el Consejo Nacional de la Magistratura dentro de lo establecido por la Constitución, pero reconociendo al mismo tiempo la necesidad de articular un sistema legal más amplio y diversificado, en el que se privilegien condiciones básicas de capacidad, probidad e idoneidad por parte de los elegidos para estas importantes funciones, y por supuesto sin perder de vista el control por parte de la opinión pública.Palabras clave: Poder Judicial, Consejo Nacional de la Magistratura, magistrado.

This is a panoramic review of the First Repealing Plenary session realised in the history of the Judicial Power of Peru. This article explains, very briefly, the pyramidal jurisdictional structure of Peru and some foreign countries like: Argentina, Chile, Bolivia, Brazil, the United States, Spain, Italy and France, making reference to the support or control systems that conforms the Judicial System in each one of these countries.

This article evidences the way of the Constitutional Law transcends the entire legal system and subjects to its provisions, constitutionalization which is strongly accentuated by the law of the Constitutional Court that complements and strengthens the legal institutions of Civil Law, in particular the Family Law.
