In this article, the author studies the vicissitudes of simultaneous death of father and son. The interpretations of Article 62 of the Civil Code have resulted in two contradictory positions, in doctrine and jurisprudence. The question proposed is if grandchildren have a right or not to the inheritance of the grandparent, who has dead at the same time as his father. This is the subject analyzed in this paper. Interpretation oriented by values underlying Law, whose aim is Justice, is preferred.

The Peruvian Civil Code, unlike the French, Spanish and Argentinean Codes, does not contemplate the revocation of the donation for noncompliance with the charge. This article is justified because even though the Peruvian Civil Code does not sanction the non-compliance with the charge with the revocation or termination of the donation, the reality can sometimes overflow the normative framework. The judge is not allowed to disregard the text of the law, since it would take away all sense, but it is up to him to find the solution to the problem within its limits, without denaturalizing it or leaving it aside with interpretations that are not in accordance with its legal nature.

En este artículo se estudiarán las vicisitudes de la conmoriencia en caso de fallecimiento simultáneo de padre e hijo. Las interpretaciones del artículo 62° del Código Civil han dado lugar, tanto en la doctrina como en la jurisprudencia, a dos posiciones contradictorias con relación a si los nietos tienen derecho o no a la herencia del abuelo, muerto al mismo tiempo que su padre; este aspecto será materia de análisis en el presente trabajo através del uso de una interpretación orientada por los valores que subyacen al Derecho cuya finalidad es hacer efectiva la justicia.

The 2017 National Census by INEI revealed that 76% of housing in Peru is owned, yet nearly half of these properties lack official titles. To address this, Laws N° 27157 and 27333 enable notaries to formalize property through acquisitive prescription. However, many of these procedures have been annulled by the judiciary due to non-compliance with legal norms. This essay examines common causes of nullity, such as deficiencies in notification and legal requirements, and highlights the need for procedural improvements. Implementing jurisprudence-based recommendations, alongside advanced technologies and continuous training, will enhance legal security and confidence in the notarial system, facilitating the formalization of informal properties and promoting economic development and social cohesion.

El estudio analiza el impacto del incumplimiento del donatario en la ejecución del cargo o modo establecido en una donación modal y evalúa si este incumplimiento concede al donante el derecho a dejar sin efecto la donación. Se emplea una investigación jurídica doctrinal, descriptiva y explicativa, con un enfoque dogmático-jurídico y filosófico del derecho. El diseño es no experimental y documental, basado en la revisión de la legislación peruana, jurisprudencia relevante y escritos doctrinales, junto con una comparación con el derecho extranjero. The article analyzes how family structures in Peru have evolved and how Article 495 of the Civil Code does not adequately reflect this diversity. Currently, only 21.8% of family units in Peru correspond to the traditional family, while 61.4% adopt other forms, such as single-parent, same-sex, and blended families, and the current legislation remains focused onprotecting only traditional family units,excluding those who do not fit this model.The analysis of the Registry Court’s resolutions shows that Peruvian legislation maintains a strict interpretation, excluding those without a spouse or dependent children from patrimonial protection.
