The present paper describes the current debate about the criminal punishment purpose, as the element that legitimates its imposition. Thus, the author analyses the existent theories to determine how the affect the judicial individualization. As culmination, there is a review of the current practical application of criminal punishment purpose in juridical system, to make some recommendations to be applied.

El presente trabajo describe el debate actual existente sobre el fin de la pena, en tanto elemento que legitima su imposición. Para dicho fin, la autora analiza las teorías existentes, con el fin de determinar cómo inciden estas en la individualización judicial. Como colofón, se sugiere una revisión práctica de la manera en la que viene operando la concepción de la finalidad de la pena, dentro del sistema planteando algunas recomendaciones.
