Under the Peruvian Civil Code, the exclusive use of a co-owned property that excludes the others co-owners, is sanctioned with the obligation to pay a proportional indemnity to the excluded party. To solve application problems of this rule such as the quantification of the indemnity, with criteria of corrective justice, and not only punitive, it is essential to determine the nature of that remedy, and, by means of the historical-comparative method, revealing its basis, and its interaction with the rights and obligations arising from the management of other people’s affairs (negotiorum gestio).

The Peruvian Civil Code commemorates its thirty years of existence. Some of its rules’content is clear, while some other rules are –in the words of the author– dark andquestionable. One of these controversial rules in its meaning and application is that contained in article 226 of the Code, relatedwith a person’s legal capacity.In this article, the author makes a historical and comparative analysis of such article, to then approach the problems contained in it, contrasting their role in the current social reality and verifying if such figure is still useful in our legal system.

This paper presents a critical analysis of the process of civil codification in Peru. To this end, the author analyses three relevant aspects of this problem: the approach or general vision of codification, the legislative technique and the working method. With regard to the initial point, it is asserted that a code must reflect the social reality, be aligned with the needs of this reality, and avoid becoming a mere instrument of academic debate. With regard to the legislative technique, the importation of foreign norms that are not compatible with the local context is questioned. Consequently, the integration of foreign legislation should be conducted with an understanding of the objectives and context in which they were created, and with an adaptation to the judicial reality of the receiving country. Este artículo es un testimonio que presenta una reflexión hecha a título personal por el autor, la cual aborda de manera crítica el rol que el Análisis económico del Derecho ha venido desarrollando en la formación de abogados en las facultades de Derecho de nuestro país. Asimismo, opina que esta corriente se ha alejado de sus postulados lógicos iniciales para terminar siendo no más que un débil sostén del liberalismo económico, lo cual ha despojado de sentido al Análisis económico del Derecho en el Perú.
