The era of Digital Customs is based on a paperless Customs due to the use of technologies to replace paper as a fundamental requirement to exercise its customs authority and offer a service with international standards. During the years 2018 and 2019, the Government, fulfilling its role as facilitator of favorable conditions for the competitiveness of Peruvian foreign trade, launched a package of measures that it sought to update the Peruvian Customs Legislation by modifying the General Customs Law and its regulations, table of sanctions applicable to offenses provided for in the general customs law and other Customs Procedures. A customs regime of infractions and sanctions are created in any state law based on a set of obligations. In other words, the board of sanctions applicable to the expected infractions in the customs general law cannot be seen on an isolated manner. Through this article, the authors intend to share their comments with the reader about the criteria of the Authorized Economic Operator — AEO) Program, as well as its benefits. Next, we will review the conditions, requirements and international standards in terms of security established by the World Customs Organization — WCO that would allow companies engaged in foreign trade to secure their international logistics chain and make Customs Clearances increasingly easy, more agile and economical.

Through this article, the author intends to inform the reader about the customs reform which took place in Peru between 2015 and 2020. Such reform, on one hand meant an improvement in our national legislation as the Customs Administration regulated more efficiently the foreign commerce operators and; on the other hand, implied a modernization in the customs service, applying quality and security systems that allow managing customs clearances in a more agile and simplified way, also ensuring full traceability of cargo and reducing final costs.

The author through this article intend to share with the reader their comments regarding the regulations established in Peru for the improvement of logistics services and the facilitation of foreign trade published in Legislative Decree 1492 and its Regulations, Supreme Decree 001-2021-Mincetur and in what corresponds to articles 9 and 10 of Law 28977. Similarly, the article seeks to analyze the reflections, doubts and questions of the sector about what it brings new and what are the implications, sanctions and obligations of the new regulatory framework for the digitalization of processes in charge of public and private entities, in the framework of the health emergency by covid-19.

This article develops concepts regarding the change in the regulations established in Peru on the certification, accreditation and authorization process of the customs representative, as well as the requirements that the customs agent must meet customs to be authorized as an economic operator to register his representative. Likewise, the author reflects on the existing legal basis, thinking about the doubts and questions that international business students and future applicants for the customs representative program may have about both figures of Peruvian foreign trade, since it must be clear that the Customs agent is the operator authorized by the Customs Administration, while the customs representative is the person accredited by the Administration for the purpose of representing one or more operators, depending on the exclusivity of the provision of their services.
