Si bien las concertaciones de precios son sólo un tipo del conjunto de prácticas restrictivas a la competencia, estas son las más dañinas desde el punto de vista del bienestar económico general debido a que no admiten explicaciones de eficiencia, por lo que, en términos de evaluaciones de impacto económico, el daño causado por ellas requiere una atención prioritaria. Los autores presentan los conceptos económicos asociados al daño económico en casos de concertación de precios y brindan pautas sobre su estimación basados en la literatura especializada y casuística más reciente sobre la cuantificación del efecto de prácticas anticompetitivas. Además, reflexionan sobre el tratamiento legal de este tema bajo la normativa peruana.

All regulatory activity from the administration has an impact on the market and on people’s actions. For this reason, it is necessary to have tools to predict and evaluate these impacts, so that the most efficient state measures are chosen, avoiding undesirable results.In this article, the authors emphasize the need for an ex post regulatory impact assessment to maintain the effectiveness of the regulatory instruments chosen. This, especially for new regulatory measures, such as the incentive scheme recently implemented by the OEFA.

Although price-fixing agreements are just one inside the group of restrictive competition practices, they are always harmful from a general economic welfare perspective because they do not admit any efficiency explanation, therefore, in terms of economic impact evaluation, the harm caused by these practices, requires a priority attention. The authors present economic concepts related to the economic harmful in price-fixing cases and brings some guidelines about estimations based on recent literature and casuistry about the anticompetitive practice’s quantification.
