This paper intends to inform the functioning of the Inter-American Human Rights System and its main institutions such as the Inter-American Court of Human Rights and the Inter-American Commission on Human Rights. In this sense, it will be evaluated how the Inter-American System has been working in relation to the right of access to public information as a fundamental tool for the control of citizenship against authority and as a institution for the strengthening of democracy.

En la actualidad se asiste a un progresivo y renovado interés por los estudios de los presupuestos del “neoconstitucionalismo”, pero al mismo tiempo existe una preocupación que se cultiva en la exigencia dialéctica de las desventajas o dificultades que puede ofrecer esta postura teórica. Esta preocupación se hace notar con mayor claridad e intensidad en los debates que se producen a nivel de la filosofía del Derecho, en el que se tiene como punto de partida el significado semántico de la expresión – neoconstitucionalismo – propuesta que no es del todo seguida, al respecto ha sido calificada como una expresión compleja, general, equivoca, vaga y ambigua.
