El objetivo de esta investigación fue determinar cómo incidió la educación jurídica en el populismo punitivo en Mariscal Cáceres - Juanjuí, 2022. El estudio presentó un enfoque cualitativo, de tipo básico y con un diseño de teorías fundamentadas; Los participantes estuvieron integrados por 100 pobladores adultos de Mariscal Cáceres - Juanjuí, quienes corroboraron que la falta de conocimiento jurídico y la existencia del populismo punitivo en el delito de violación de menor de edad; también participaron 6 expertos, quienes aportaron conocimientos relevantes sobre las categorías; las técnicas utilizadas fueron la técnica de la entrevista y la encuesta; los instrumentos aplicados fueron la guía de entrevista y el cuestionario. La investigación titulada "Derecho al debido proceso y declaratoria de contumacia en los acusados por los juzgados penales unipersonales de Tarapoto del 2010 - 2014", tuvo como objetivo general determinar la relación entre el derecho al debido proceso y la declaratoria de contumacia en los acusados por los juzgados penales unipersonales de Tarapoto, periodo 2010 - 2014. El tipo de estudio fue no experimental; el diseño de la investigación fue descriptivo correlacional, asimismo la investigación contó con una muestra de estudio de 54 resoluciones emitidas, las cuales fueron seleccionadas a través de un muestreo no probabilístico intencionado ya que se tomaron 27 resoluciones con declaratoria de contumacia y 27 restantes con resoluciones con declaratoria de no contumacia, además fueron evaluados mediante la ficha de observación (Lista de Cotejo) con el fin de recolectar informaci...

The punitive populism is characterized by the popular demand for increased penalties and inflexibility in the normative criminal treatment of the accused (elimination of procedural and penitentiary benefits). This populism has fallen especially and palpably on the crime of the sexual violation of minors. The hardening of the legal and punitive treatment for the mentioned crime is notorious since in 2018 life imprisonment was extended. In addition, we have the prohibition of the application of procedural simplification through early termination or conclusion for crimes against sexual freedom, which degenerates the criminal process, delaying it, in many cases, unnecessarily. In the middle of the 21st century it is unimaginable that citizens can live outside the law, especially criminal law; however, as a paradigm, in certain cities of Peru it is usual to start a common-law union and a family with 14-year old minors. This assertion is not only notable for the news, but also for the criminal proceedings that are exposed in the judiciary, since this practice qualifies as a crime of sexual assault against minors, a subject that has been discussed arduously and recently in the Peruvian criminal jurisprudence. The importance of the victim’s testimony in the Peruvian criminal process is so significant that it has been addressed by the Supreme Court of Justice of Peru. Plenary Agreement No. 2-2005/CJ-116 established that the victim’s testimony must pass through a filter—truthfulness indicators—to be considered valid evidence capable of undermining the presumption of innocence of the defendant. Plenary Agreement No. 5-2016/CJ-116 reiterates that in cases of violence against women and family members, the truthfulness indicators must be applied to the victim’s testimony. This has subsequently been legalized in the Regulations of Law No. 30364, Law to Prevent, Punish, and Eradicate Violence against Women and Family Members, Supreme Decree No. 009-2016-MIMP, dated July 27, 2016.
