In this paper, we attempt to analyze the relationship between the novel Unworthy of a Human, by Osamu Dazai, and the human right to mental health, trying to identify legal aspects that relate to the subject, from a human rights, social and criminal perspective, both in postwar Japan and today, in order to reflect on the role played by society and the judicial system with respect to people who face mental health problems and the consequences that these cause.
