El trabajo muestra la configuración orgánica del Tribunal Constitucional en los dos últimos textos constitucionales del Perú (1979-1993). Este análisis se realiza en paralelo, destacando las ventajas del texto constitucional de 1979, no solo en cuanto a la forma de selección de los magistrados, sino también en su número y la duración del mandato. El autor concluye su análisis cuestionando la forma de selección de los jueces del máximo órgano jurisdiccional en la experiencia reciente, en la que se ha confiado finalmente a los portavoces de los partidos políticos, esta importante tarea. De este modo, el autor considera que se estaría relegando la participación no solo de los demás poderes del Estado, que eran quienes proponían los candidatos conforme al texto de 1979, sino de la sociedad civil en su conjunto.

The paper analyzes the presence of the national margin of appreciation doctrine (NMA) in the reasoning developed in the inter-American human rights system, from a perspective of articulation between the Inter-American Court jurisdiction and States internal jurisdictions. The argument that is defended in the paper maintains that, in the framework of an open process of implementation of a globalized model of constitutionalism, a certain level of NMA is not only necessary for the inter-American judicial dialogue, but also even indispensable.
