La presente investigación tuvo el objeto de explicar cómo una deficiente política criminal colaboró en el aumento de la delincuencia y criminalidad en el distrito judicial de Huánuco, durante el periodo comprendido en los años 2016 a 2017, y el nivel de participación de los operadores jurídicos (jueces, fiscales y abogados) en aquel resultado; empleándose para tal propósito un tipo de investigación básica, dentro de un nivel: descriptivo–no experimental. Además, el estudio adoptó un diseño transversal, pues se obtuvieron los datos requeridos a través de la técnica de la observación y medición, con su respectivo instrumento de registro de datos y análisis, así como de encuestas, con su técnica el cuestionario, aplicada a un significativo número de operadores jurídicos. The oralization settlement in the labor process has implied a different dynamic from that previously had. But this has not been the only change in the labor reform. Therefore, the new procedural system has incorporated diversity legal process forms of settlement agreements. Thus, the employer or employee can exercise their right of action to resort to other mechanisms that resolve disagreement in the employment relationship. This new legislative method has brought us to establish two antagonistic positions: on the one hand, some who support the viability of applying the availability test based on private autonomy and the initiative of part in the process; and on the other hand, those who argue, under the principle of inalienability, the protective role that the judge should have against these processes.

Corrupt acts committed within state institutions by a minority of individuals for personal gain are socially and legally unacceptable, as they distort the collective objectives of public administration and affect society in general, as corruption prevents altruistic activities (hospitals, schools, bridges, roads) from being carried out for the benefit of citizens. On the contrary, the rate of corruption in our country is on the increase, but the most scandalous thing is that these people, who are dedicated to diverting public goods or services, are free from the weight of justice, as they manage to flee the country until the criminal case against them expires and are exempt from any criminal sanction. This research arises from the need to reduce corruption within public institutions, specifically, in government procurement. At present, it is clear that corruption has reached every sector of the government, even in the most complex government systems, such as public procurement, where a large amount of money is spent to achieve a collective goal. However, such a social goal is cut short by corruption acts within public agencies when executing contracts. In this regard, to stop such illegal acts in State procurement, it is necessary to supervise the actions of procurement agents. Criminal compliance thus emerges as a solution to curb this social problem in the form of a regulatory compliance program designed to reduce the risk of corruption acts.
