There was always concern us regarding the subject matter of law, was great our surprise, followed by a natural confusion, when the legal philosopher illustrious Juan Bautista de Lavalle, who was in charge of the course Introduction to Law in the first year of Faculty, explained--taking it for granted which, according to Hans Kelsen, the object was legal because, in accordance with the postulated by the Pure Theory of Law standards, social values human life and belonged to metalegal. They were, therefore, beyond the boundaries of law. The reaction that we raised exposure of that teacher, described above, had an explanation which, according to our philosophy studies completed at the Faculty of Arts at the Mayor de San Marcos National University, was impossible to miss the human being and values, senses and lived by him, of any discipline relating to knowledge of the behavior of human being...

El presente artículo trata brevemente sobre la naturaleza o estructura formal de la persona denominada "jurídica', así como también de los alcances conceptuales de la "capacidad jurídica". A través del presente texto se expone el punto de vista personal del autor sobre dicha temática, distanciándose de las concepciones tradicionales sobre dichas instituciones jurídicas aún vigentes en la doctrina, la legislación y la jurisprudencia de nuestros días.

The terms “anti-juridicity” and “custodial sentences” are widely used in the legal world. In this article, the author encourages to question both terms, analyzing if they are coherent with, precisely, what is understood as Law. First, the author wonders if it is correct to talk about “antijuridicity”, taking into account the subject of Law, the ways in which Law is manifested, and the relation between juridicity and Law.Further on, the author analyses if it is correct to talk about a “custodial sentence”, considering the relation between liberty and the human being. All through the article, the author also recounts how the ideas in Law have evolved through recenthistory.

The author makes a critical analysis of how over time it has tried to find the subject of study of Law and how it is distinguished from other beings that make up the universe. t hus the rational dimension of man has passed his ontological analysis as being in itself which makes it unique and spirit as the arrangement will be co-existential seeking protection for the same freedom he has. Finally, the author focuses on the own “freedom” of man and of which the other rights it has.

In 1965 a Reforming Committee, formed by the leading specialist teachers in each of the books of the Civil Code, was created forreviewing  the  Peruvian  Civil  Code of 1936. After about twenty years, the effort of thehard work of the committee resulted in the enactment of the 1984 Civil Code, which we currently use and know.In this article, the author shares his experience as a legislator, emphasizing new and important aspects included in the Civil Code of 1984. He also proposes possible amendments to the First Book of the current Civil Code, such as the incorporation of standards related to Genetics, a comprehensive review of the subject related to legal capacity, reviewing the subject regarding foundations, among others.

En el presente artículo el autor, tomando como base una sentencia de la Corte Interamericana de Derechos Humanos, analiza la importancia del proyecto de vida y los daños que se le puede ocasionar.

En este artículo el autor; partiendo de un profundo análisis filosófico de la conducta humana elabora el concepto del "proyecto de vida", distinguiéndolo del "daño psíquico". El proyecto de vida, fruto de la libertad, compromete todo el ser del hombre, por lo que dañarlo genera como consecuencia una pérdida del sentido de la vida. El daño al proyecto de vida, por tanto, debe ser considerado en opinión del autor, entre los objetos de preocupación del jurista.

This article reflects on the figure of “life project”, focusing on its philosophical foundations, and its relation to freedom and the person as a “freedom being”.
