This essay offers a feasible and verifiable theoretical basis for affirming what is called the fourth procedural paradigm, corresponding to the constitutional perspective of the civil procedure or the constitutionalization of it, as an overcoming of its previous classical and instrumentalist stages. To this end, through the interdisciplinary method, the research uses constitutional law, legal interpretation and procedural law to reshape the theoretical bases of the civil process and give it a constitutionalized value through the recognition of fundamental procedural rights as directly applicable norms containing optimization mandates. The task of the Supreme Courts and the Constitutional Courts has undergone an evolution through years of history, from its classic reactive role to a more proactive one, which prevails in the current models.In this article, the author analyzes this evolution describing the roles -and their basis- of control of legality, as a classical function, and to give meaningto the normative text and complete the meaning of the legislative document with binding precedents, as a contemporary function. The author completesthe analysis focusing on the overruling and its application in Perú.

La labor de las Cortes Supremas y Cortes Constitucionales ha sufrido una evolución a través de la historia, desde su clásica función reactiva hasta la función proactiva, imperante en los modelos actuales. En el presente artículo, el autor analiza dicha evolución describiendo las funciones y sus fundamentos del control de legalidad, como función clásica, y la de otorgar sentido al texto normativo y completar el significado del documento legislativo con precedentes vinculantes, como función contemporánea. Completa el análisis con el estudio del overruling y su aplicación en el Perú.

El Derecho es un conjunto de signos que permiten diversos significados por quienes los interpretan, es decir, operan con estos signos lingüísticos jurídicos. En ese sentido, ante la multiplicidad de significados pasibles de ser extraídos de los documentos normativos, debe existir un medio o instrumento encargado de concentrar el significado final en determinados contextos y de velar por su unidad, dado que en la interpretación del Derecho realizada por la judicatura reinan la incertidumbre y el disenso.
