Objetivo. Determinar la relación entre la ausencia del instituto de la extromisión en el sistema procesal penal peruano y el procesamiento injusto. Métodos. Se llevó a cabo un estudio descriptivo correlacional compuesto por 24 fiscales y tres resoluciones de extromisión en los procesos penales de los últimos tres años de entrada en vigencia del Nuevo Código Procesal Penal en el Distrito Judicial de Huánuco período 2012 - 2014. Se utilizó una guía de entrevista y una ficha de análisis documental. Para el análisis inferencial se utilizó la Prueba Chi cuadrada. Resultados. En general, 79,2% (19 casos) presentaron procesamiento injusto y 12,5% (3 casos) presentaron extromisión en el sistema procesal penal peruano.
