This article analyzes the regulatory evolution and regulatory challenges associated with the implementation of Complementary Services in the Peruvian electricity sector, in the context of the recent modification of Law 28832 and taking into account the Chilean comparative experience. In such manner, the current conditions of the regulatory framework and the need to introduce incentives that promote the participation of new actors are examined, especially given the increase in the penetration of intermittent renewable energies.

El objetivo del presente trabajo es desarrollar una respuesta ante la interrogante de si las empresas estatales de generación eléctrica cumplen o no un rol subsidiario en dicho mercado, a la luz del principio de subsidiariedad que se desarrolla en el segundo párrafo del artículo 60° de la Constitución Política del Perú de 1993. Luego de una investigación, confirmando la hipótesis, se concluye que es necesaria una reinterpretación del principio de subsidiariedad, en la medida que una lectura del mismo no debe limitarse a su fase negativa o deber de abstención del Estado, sino también a su fase positiva o deber de intervenir del Estado cuando subsistan razones que así lo requieran. COVID-19 has undoubtedly generated a business crisis that will not be easy to resolve. In this context, the failing firm defense becomes especially relevant, having been expressly introduced for a few months in Peruvian legislation on the occasion of the pandemic through Legislative Decree 1510, in order for the competition agency to take this aspect into account in its merger control decisions. Although, subsequently through Law 31112, Law that establishes merger control, the failing firm defense is o mentioned, this law leaves open the possibility of its application.In this article, the authors analyze the failing firm defense, in order to comprehend its importance in the context of the pandemic. Also, they propose guidelines and amendments to strengthen the regulation of Law 31112.
