This paper deals with the study of the liability of the owner of the ship in the Peruvian Law. Traditionally, the rules of “Libro” III of the Peruvian Commercial Code have generated some uncertainty about their scope on this matter. This paper proposes an interpretation of the Commercial Code rules that allows to understand them in a coherent way, especially with the context in which they were passed. The many aspects around the liability of the owner of the ship exceed the field of mere civil liability and nowadays the obligations that the owner of the ship assumes under the public regulation constitute a very important aspect for the modern shipping company. For these reasons, the author also proposes a general approach to the “administrative liability” of the owner of the ship considering the most relevant rules of the Peruvian domestic Law and the main international treaties.

This paper deals with the study of the Documentary Credit as a mechanism of payment in international trade transactions. The main objective is to explain, in general, a number of issues relating to this figure by presenting the reader with the relevant information with regards to the payment mechanism and the roles of the individuals involved in the contract itself. This paper is by no means an exhaustive study about the Documentary Credit but a brief approach to a subject rarely addressed in national Law and the importance of which is not always highlighted.

Despite the close relationship between the two groups, they show a different legal basis. In the first case, the principles of private law, including freedom of form, regulate its legal framework. However, in the second case, the requirements come from a public control over the companies, which is manifested in the need to have a public deed, which must be entered in the public registry
