This article base line bears on the relevance of the process– developed after 1945– of law’s constitutionalization, its foundations established and main characteristics. This process is framed by HumanRights fully implementation, such as rejection of impunity concerning serious human rights violations, respect to due process, the integrality and indivisibility of human rights, also respect to indigenous people and limits to state of emergency. Finally, through reviewing laws for compliance, the author highlights the importance of jurisdictional bodies for an effective fulfillment of constitutional and supranational rules signed by the States.

A first reading of the anti-corruption treaties in force shows that they do not establish any direct relationship with human rights. This situation is replicated with the treaties that deal with human rights in the international legal system, since there is no palpable link between them and corruption. In this context, the purpose of this study is to find the relationship between corruption and human rights from an international legal perspective. Although there is no ostensible link between the aforementioned concepts, the author argues that the fight against and prevention of corruption has its origin in the United Nations Charter and regional charters, since acts of corruption are contrary to the principles of those charters. To that extent, corruption represents a threat, affectation and hindrance to human rights and, in certain cases, represents a violation of those rights.

In December of 2017, within the framework of the Rome Statute that creates the International Criminal Court, the 16th Assembly of States Parties adopted by consensus the Resolution ICC-ASP / 16 / Res.5, entitled «Activation of the jurisdiction of the Court over the crime of aggression». Under the aforementioned Resolution, it was established: (i) the definition of the crime of aggression adopted in 2010 by the Conference of States Parties to the Rome  Statute, held in Kampala (Uganda) has become applicable. Likewise, the universal scope of the criminal sanction of this crime is reaffirmed, by virtue of non-conventional international legal norms, like customary norms or jus cogens, and (ii) effective jurisdiction is granted to a jurisdictional body, the International Criminal Court, in order to administer justice with respect to the crime of aggression.
