El presente trabajo tiene por objeto analizar la denuncia presentada por el entonces Instituto de Formación Bancaria ante la Comisión de Fiscalización de la Competencia Desleal de la sede central del Indecopi frente al Instituto de Educación Bancaria por la comisión de actos de competencia desleal en las modalidades de actos de confusión, aprovechamiento indebido de la reputación ajena y violación de secretos empresariales. La investigación se justifica en la importancia de la manifestación de la libre iniciativa privada y las consecuencias que su represión podría traer, para lo cual se efectuará un análisis del derecho a imitar como manifestación de la libre iniciativa privada, de las competencias con las que cuenta la Comisión de Fiscalización de la Competencia Desleal del Indecopi, así como de lo actuado en el procedimiento. This article addresses the problem noted in the Peruvian Bankruptcy Law: the bankruptcy authority has been unable to neutralize payments of bankruptcy credits made outside the rules of bankruptcy. We are faced with the need for debtors to continue with business activity, to generate greater wealth and not increase the crisis they are going through, while we are faced with the possible denaturalization of the bankruptcy procedures. To address this problem, the author will propose the implementation of a regime of action that allows the balance between the need for payments and the bankruptcy procedure.
