The Community Land Trust is a collective stewardship land tenure model from the United States that has proven to be effective in both generating and maintaining affordable housing around the world. In this paper, we demonstrate that this model is needed as an alternative in the current housing policies. Subsequently, we identify the elements of the Community Land Trust, in accordance with American regulations and practice. Then, based on a review of the specialized literature, we gather the experiences of the implementation of this model in the United States, England, and Canada, as well as its recent spread in Latin America with the experiences of Puerto Rico and Brazil. Finally, we identify the challenges, potential objections, and opportunities for its implementation in Peru.

Possession has become a central concept in the discussion on land tenancy and adequate housing.That is why it demands a shift from the traditional Civilian Law understanding of its legal nature. This paper aims to response to the Theory of the Resizing of Property - TRP, which argues for a constitutional right of possession to incorporate informal property within it.Using a case study methodology, we argue that, on the one hand, the recognition of rights does not lead to an improvement in dwellers living conditions; and, on the other hand, that informal property, far from being outside the Government, is based on legal practices promoted and recognized by it, which consolidate the informal land tenancy generation.

La presente investigación tiene por objetivo explicar la realidad jurídica en torno a la ordenación de los tipos en los derechos reales, analizando y distinguiendo el concepto de tipicidad y la regla del numerus clausus. A partir de ello, exponer los fundamentos para la flexibilización del tipo y su ordenación a través de grados en los derechos reales.
