The text is not intended to provide solutions to a well-known problem within the guild of political scientists and lawyers. This phenomenon is currently generating, in varying degrees, an extensive intellectual production and a critical reflection, which aims to shed some light on the way and the way of functioning of political systems in this era of dissolution of the old system of management international, after the fall of the wall and the decomposition of the former Eastern Bloc. The accent falls especially on the democratic political systems in the orbit of the Western world where the emergence of certain 'perverse' processes would seem to presage the fact of a deep crisis of the representative systems. Of this they give account the news and reports that appear in the press and in the rest of the means, referred to a series of public scandals.

La presente investigación toma como punto inicial la preocupación por los derechos de los niños, niñas y adolescentes, así como el correcto tratamiento en aquellos casos en los que se encuentran inmersos los menores de 14 años cuando realizan lo que se denomina acto infractor, pues una vez revisados los procesos materia de investigación se apreciaba soluciones disimiles que no partían de criterios objetivos que puedan ser generalizados en todas las investigaciones. Si bien el Código de los niños y adolescentes, señala que adolescente infractor es aquel que tiene más de 14 años y menos de 18, la consecuencia directa de dicha norma nacional es que los menores de 14 años no se encuentran sometidos al sistema penal juvenil de adolescentes, pues se encuentran debajo de dicha edad mínima, sin embargo, y pese a ello, se aprecia que en algunos casos se aplicaba normatividad y fund...

Through this work, we want to call for reflection to all legal operators involved in the issue of children and adolescents under 14 years of age who come into conflict with the criminal law by having committed unlawful acts. We notice the lack of clear and precise rules that allow us to determine what is the most suitable and adequate protection measure for this child population. Similarly, , we intend to promote a healthy debate on what is the purpose of the tutelary processes that are established for this purpose, since at the beginning we consider that these tutelary are different from the processes that are established for reasons of abandonment.
