El profesor Elmer Arce Ortiz pone la lupa, en esta ocasión,sobre la regulación de las relaciones laborales de los artistas. Cierto esque en ellas es común identificar los tres elementos que configuran unarelación sujeta al Derecho del trabajo, pero también, como se destaca enel primer capítulo de este libro, existe un conjunto de peculiaridades quejustifican un tratamiento legal específico.

Nuestra legislación ha exhibido en materia de estabilidad laboral, desde 1991 en adelante, la tendencia creciente a sustituir el régimen de estabilidad absoluta, en el que se reconoce al trabajador injustificadamente despedido el derecho a su reposición en el empleo, por la estabilidad relativa, en el que el afectado sólo tiene derecho al pago de una indemnización. Sin embargo, se reservó un campo en el que esa sustitución de mecanismos reparatorios no operó: el despido nulo. En este caso, cuando no sólo hubiera ausencia de fundamento para la extinción del vínculo laboral, sino que ésta derivara además de la vulneración de determinados valores constitucionalmente relevantes, el trabajador tendría derecho a ser readmitido en su puesto. The phenomenon of informality in Peru is a complex and multifaceted one, reflecting the limitations of the capitalist system in providing decent and survival-enhancing jobs for citizens. The author postulates that the phenomenon of informal activity can be attributed to two fundamental reasons. The first of these reasons relates to unfavourable economic circumstances that force people to act outside the law. The second reason is the intention to deviate from the law in order to increase income in a particular activity. In this context, the social effects of informality include the exclusion of social rights and social segmentation, which serves to highlight the urgency of public policies that address informality as an integral component of society.
