La presente investigación tiene como punto de partida la problemática ocasionada en la adquisición y disfrute de una vivienda. Comenzar manifestando que el siglo XXI obliga al Derecho a estudiar nuevas realidades y conflictos surgidos frente al derecho de la propiedad en las ciudades, donde los propietarios se agrupan para formar las llamadas “Unidades Inmobiliarias”. Referir que, ante la escasez de espacios y de medios económicos surge como alternativa el “Derecho de vuelo”, denominado así a la proyección vertical de una construcción hacia arriba (aires o azoteas) y hacia abajo (subsuelo o sótano). En el Perú no existe dispositivo legal que reconozca al derecho de vuelo como un derecho real autónomo, a pesar de su gran relevancia jurídica. En las legislaciones extranjeras por el contrario existe una amplia regulación (España, Portugal, Puerto Rico, México y Argenti...

The purpose of this article is to describe the reality on the application of immediate proceedings and the possible violation of principles and defendant’s guarantees in the cases resolved in the Units against Flagrante Delicto. Accordingly, an analysis of the existing regulations and the casuistic on immediate proceedings in flagrante delicto will be carried out, which will evidence the violation of the defendant’s rights, and will conclude on the need to reform the procedural rule establishing the procedures for the Units against Flagrante Delicto to follow.
