The class action was established in the 19th century, highlighting its relevance over time. In Peru, its incorporation materialized with the Constitution of 1933. However, since its implementation, several problems have arisen in its understanding. The objective of this paper is to clarify the deficiencies present in Article 133 of the Political Constitution of Peru and to propose an exegesis congruent with the normative text. To this end, the context, content and application of the norm in question will be analyzed in order to arrive at the most adequate reading of the aforementioned article.
