El presente expediente versa sobre un procedimiento penal por el presunto delito de violación sexual a una persona en incapacidad de resistir, tipificado en el artículo 172° del Código Penal. En dicho proceso la agraviada es una menor de edad, quien manifestó haber mantenido relaciones sexuales consentidas con su enamorado de iniciales M.T.C (25); sin embargo, durante las investigaciones se dio a conocer que la menor fue diagnosticada con retardo mental leve. Por su parte, el imputado refirió que no tenía conocimiento de la discapacidad mental de la agraviada, puesto que, a simple vista parece una persona normal. Y que, en caso de haberlo sabido, no hubiera mantenido relaciones sexuales con ella. Teniendo en cuenta lo expuesto, se infiere que los principales temas jurídicos del presente proceso son los siguientes: i) violación sexual de persona en incapacidad de resistir; ii) libertad sexual; iii) indemnidad sexual y iv) error de tipo. |

Y que, en caso de haberlo sabido, no hubiera mantenido relaciones sexuales con ella. Teniendo en cuenta lo expuesto, se infiere que los principales temas jurídicos del presente proceso son los siguientes: i) violación sexual de persona en incapacidad de resistir; ii) libertad sexual; iii) indemnidad sexual y iv) error de tipo.This file deals with criminal proceedings for the alleged crime of rape of a person incapable of resisting, typified in article 172 of the Penal Code. In said process, the aggrieved party is a minor, who stated that she had had consensual sexual relations with her boyfriend with the initials M.T.C (25); however, during the investigations it was revealed that the minor suffered from mild mental retardation. For his part, the defendant stated that he was unaware of the mental deficiency of the aggrieved, since, at first glance, he appears to be a normal person. And that, if he had known, he would not have had sex with her.
