Tras la denuncia de desaparición de su madre, la menor apareció y se comprobó que había sido víctima de violación sexual. La menor, que presentaba retardo mental moderado con una edad mental de seis años, identificó a R.E.B.C. en una entrevista en Cámara Gesell. Aunque el denunciado negó conocer a la agraviada y haber tenido relaciones sexuales con ella tras ser intervenido en noviembre de ese año, la Fiscalía formuló acusación por los delitos de secuestro agravado y violación sexual de persona en incapacidad de resistencia en octubre de 2016. La Cuarta Sala Penal de la Corte Superior de Justicia de Lima decidió condenar a R.E.B.C. únicamente por el delito de violación sexual de persona en incapacidad de resistencia, imponiéndole una pena de treinta años de prisión y una reparación civil de S/. 10 000.00. La defensa del condenado presentó un recurso de nulidad, y la Corte Suprema (Recurso n.° 1879-2017) confirmó la sentencia condenatoria por violación sexual.
