Se estableció que el imputado habría difundido publicidad de su establecimiento de salud aludiendo que tenía la condición de “clínica” cuando en realidad no ostentaba dicha categoría según los parámetros legales de salud. Notificada la resolución, el imputado presentó sus descargos; sin embargo, no argumentó sobre el fondo de la imputación. El 12 de enero del 2021, la Comisión de la Oficina Regional del Indecopi de Tacna, declaró fundado el procedimiento iniciado de oficio y sanciona al imputado, argumentando que no se acreditó que la autoridad correspondiente haya emitido la resolución respectiva que le otorgue la condición de clínica. Interpuesto el recurso de apelación, 30 de septiembre del 2021, la Sala Especializada en Defensa de la Competencia confirma la resolución apelada argumentando que el imputado solo estaba autorizado para publicitarse como “policlínico” y no como “clínica”, ya que pertenecían a distintas categorías según las normas técnicas de salud.
