M. Q., Tramitado el respectivo proceso (en la vía ordinaria), en primera instancia, la Sala emitió sentencia en la cual condenó al acusado E. J. P. F. como autor del delito contra el patrimonio – robo agravado, en grado de tentativa y como tal le impusieron siete años de pena privativa de libertad y fijaron en mil soles el pago por concepto de reparación civil, suma que debería pagar el sentenciado de manera solidaria. Asimismo, luego de ser intervenido el procesado, J. G. R. y desarrollado el juicio oral, se emitió sentencia en la cual se le absolvió. Por su parte el sentenciado E. J. P. F., interpuso recurso de nulidad contra la sentencia emitida en su contra. Dicho recurso fue resuelto mediante sentencia que declaró haber nulidad en la sentencia impugnada y reformándola absolvieron a E. J. P.
