Posteriormente, permitió al demandado residir temporalmente en el bien, pero al negarse este a restituirlo y no pagar ningún tipo de merced conductiva, interpuso la demanda sustentándose en los artículos 911 y 923 del Código Civil, referidos a la posesión precaria y al derecho de propiedad. El Vigésimo Juzgado Especializado Civil de Lima declaró fundada la demanda, ordenando el desalojo del demandado. El demandado apeló la decisión alegando falta de notificación adecuada y la existencia de un compromiso moral con la demandante respecto al inmueble.
