description El fraude inmobiliario ha encontrado en las deficientes normas que regulan el procedimiento registral de inmatriculación de predios o primera de dominio una puerta a la ilegalidad para crear derechos de propiedad y además otorgarles seguridad jurídica, esto ha ocasionado un enriquecimiento indebido e ilegal por parte de traficantes de tierras en desmedro de los verdaderos y legítimos posesionarios y/o propietarios, entre los cuales muchas veces se encuentra el propio estado peruano, por ello surge la necesidad de proponer una correcta regulación de dicho procedimiento, a fin de salvaguardar la legalidad y cubrir las deficiencias legales, para ello es importante comprender el fundamento de la inmatriculación predial, la cual es la prescripción adquisitiva de dominio corta y a su vez el fundamento de esta, que es la posesión, así como comprender los principios y fines del registro público.
