description El presente trabajo de investigación expone como principal objetivo analizar la forma y circunstancias sobre cómo afecta el requerimiento de acusación complementaria sobre el derecho constitucional de defensa que le asiste a la parte imputada, dentro del proceso penal peruano; debiéndose revisar los criterios jurídicos que se han establecido en el Código Procesal Penal y jurisprudencia vinculante para incorporar la acusación complementaria en el debate plenarial, donde el Juez de Juzgamiento deberá efectuar el control de legalidad del mismo, corriendo traslado a la defensa técnica para que absuelva dicha acusación en el pleno ejercicio de la defensa; no obstante, en la realidad procesal se ha podido visualizar el problema en torno a la oportunidad de presentación de la acusación complementaria, esto es, en qué momento de la audiencia de ju+icio oral debe presentarse, para su oralización y oposición, el tiempo otorgado para que la defensa puede formular observaciones, como suele suceder con el traslado normal de un requerimiento acusatorio en la etapa intermedia; y, de esta manera determinar cuál sería la interpretación más adecuada, del inciso segundo, del artículo 374 del Código Procesal Penal sobre la tramitación de la acusación complementaria
